The National Tertiary Education Union (NTEU) believes that an organised, powerful and representative union is the foundation to creating fairer workplaces and making our universities great places to work and study. By fostering a democratic organisation, NTEU empowers employees to have a voice on critical workplace issues.
THE ROLE
Workplace Representatives (Delegates) play a critical role representing their colleagues and are the day-to-day face of the union, connecting members in their workplace with the rest of the union. Workplace Representatives (Delegates) advance and protect the collective interests of NTEU members and their wages, conditions, and welfare through:
- Campaigning for better pay and conditions.
- Building union strength by involving members in collective action and asking colleagues to join the union.
- Organising and leading local union meetings.
- Inviting other activists and workplace leaders to union training.
- Providing information and advice to members.
- Supporting and representing union members as needed.
- Updating the Branch Committee about any workplace issues or problems
RIGHTS AND PROTECTIONS
Workplace Representatives often enjoy significant rights and protections under our Enterprise Agreements. In addition to this, further rights for union delegates have been introduced into the Fair Work Act 2009 (the FWA), including rights to:
- Represent the industrial interests of union members and potential members in their workplace.
- Reasonable communication with members and potential members in relation to their industrial interests during work time (as long as this does not hinder or prevent the normal performance of work).
- Encourage eligible employees to join the union.
- Reasonable access to the workplace and workplace facilities
- Reasonable access to paid time during normal working hours for the purpose of delegate-related training
By law, a delegate’s employer must not:
- Unreasonably fail or refuse to deal with the workplace delegate.
- Knowingly or recklessly make a false or misleading representation to the workplace delegate.
- Unreasonably hinder, obstruct, or prevent the exercise of the workplace delegate’s rights under the FWA or an applicable award or Enterprise Agreement.
RESPONSIBLIITIES
NTEU Workplace Representatives (Delegates) are expected to:
- Work with elected officers and staff to promote the interests of the NTEU in solidarity with all members.
- Respect everyone’s rights and dignity regardless of gender, sexuality, age, gender identity, religion, language, politics, national or ethnic origin, or disability.
- Adhere to the NTEU rules, policies and Code of Conduct.
- Listen to the views of the members they represent but not present their personal views as the views of the NTEU.
- Avoid making commitments or legal agreements on behalf of the NTEU or its members.
- Maintain the confidentiality NTEU member data and other sensitive information
- Complete required NTEU Delegate training.
- Use their position for the benefit of the union and the members they represent, and not for personal gain.
